DMCA Copyright Policy

Commitment to Copyright Protection

Aniwave operates with full respect for intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) of 1998. We take copyright infringement seriously and respond promptly to valid takedown notices submitted in accordance with applicable laws.

Our platform functions as an anime index and search directory, connecting users to content hosted on external third-party platforms. We maintain a proactive approach to copyright compliance and work cooperatively with rights holders to address legitimate concerns.

Understanding Our Platform

Critical Information: Aniwave operates exclusively as a search engine and content aggregator for anime information and links. We do not upload, store, host, or transmit any video files on our servers or infrastructure. Our service functions similarly to general search engines (like Google or Bing) by indexing publicly available content and providing links to third-party hosting platforms.

All anime content displayed on our platform is:

  • Hosted entirely on independent third-party servers beyond our control
  • Sourced from publicly accessible URLs available across the internet
  • Not stored, cached, or maintained on Aniwave infrastructure

We function as an intermediary service that organizes and catalogs anime content links, similar to how search engines index web pages. The actual video files reside on external hosting platforms that maintain their own independent operations and content policies.

Proper DMCA Procedure

If you are a copyright owner or authorized agent and believe your copyrighted work is accessible through our link directory, we recommend the following course of action:

Step 1: Contact the Actual Content Host

Since we do not host video content, the most effective way to remove infringing material is to submit a DMCA takedown notice directly to the third-party platform hosting the content. This ensures permanent removal from the source rather than simply delisting a link.

Step 2: Submit a Notice to Aniwave

While we encourage direct contact with content hosts, we will also process valid DMCA takedown requests to remove links from our index. Your notice must include all required elements under 17 U.S.C. § 512(c)(3):

  • Signature: Physical or electronic signature of the copyright owner or authorized representative
  • Identification of Work: Clear identification of the copyrighted work claimed to be infringed (including title, episode numbers, and registration information if available)
  • Location Information: Specific URL(s) or detailed description of where the allegedly infringing material is located on our platform
  • Contact Information: Your full name, mailing address, telephone number, and email address
  • Good Faith Statement: A declaration stating: "I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law"
  • Accuracy Statement: A declaration under penalty of perjury stating: "The information in this notification is accurate, and I am the copyright owner or authorized to act on behalf of the copyright owner"

Important: Incomplete or improperly formatted notices may not be processed. Please ensure all required elements are included to avoid delays.

Counter-Notification Procedure

If you believe content was removed from our index as a result of mistake, misidentification, or fair use, you may submit a DMCA counter-notification pursuant to 17 U.S.C. § 512(g).

Your counter-notification must contain:

  • Signature: Your physical or electronic signature
  • Identification: Description of the material removed and its previous location on our platform
  • Perjury Statement: A statement under penalty of perjury: "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification"
  • Personal Information: Your full name, address, and telephone number
  • Consent to Jurisdiction: A statement consenting to the jurisdiction of the Federal District Court for your judicial district (or where Aniwave is located if outside the United States)
  • Service Agreement: A statement that you will accept service of process from the party who submitted the original takedown notice

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed link at our discretion.

Submitting DMCA Correspondence

All DMCA takedown notices, counter-notifications, and related correspondence should be submitted through our official Contact Form. Please use one of the following subject lines:

  • "DMCA Takedown Notice" for removal requests
  • "DMCA Counter-Notification" for counter-notices
  • "DMCA Inquiry" for questions about the process

We aim to process all valid DMCA requests within 2-5 business days of receipt. You will receive confirmation once your notice has been reviewed and processed.

Repeat Infringer Policy

Aniwave maintains a strict policy regarding repeat copyright infringement. In accordance with 17 U.S.C. § 512(i),we will terminate access for users or content sources that are the subject of repeated valid infringement notices. Our platform actively monitors and maintains records of DMCA activity to enforce this policy effectively.

Misuse of DMCA Process

Please be aware that submitting false, fraudulent, or bad-faith DMCA notices may result in legal liability under 17 U.S.C. § 512(f). This includes submitting takedown requests for content you do not own or have no authority to represent. We reserve the right to seek damages and attorney's fees from parties who misuse the DMCA process.
